Rape and murder of a tribal woman: NHRC directs Telangana Government to pay compensation under PoA Act

On 5 April 2021, the National Human Rights Commission (NHRC) directed the District Magistrate & Collector of Sangareddy District of Telangana to pay compensation to next of kins a tribal woman, who was raped and killed, under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The deceased tribal woman, aged about 32 years, was abducted by three persons identified as Vaditya Madhu Nayak, Talluri Kutumba Reddy on 3 November 2020 from her mother’s home in Miyapur, outskirts of Hyderabad and gang-raped. On 4 November 2020, the accused persons killed her in an isolated location.

The NHRC acted pursuant to a complaint filed by ILAI, which was registered as Case No. 1835/36/2/2020-WC.

A case was registered u/s 366/376D/302 IPC r/w 3(2)5 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. All the three accused persons were and sent to judicial custody.

In its order, the NHRC directed the Commissioner of Police, Cyberabad to get the investigation completed fairly and to its logical conclusion within reasonable time. Further, the District Magistrate & Collector, Sangareddy was directed to provide compensation to the next of kin of the deceased tribal woman as per the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
